1. Acceptance of Terms

By accessing or using the OneCallShield website (onecallshield.com) and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, consumers submitting quote requests, and insurance agents using our platform.

2. Description of Service

OneCallShield is an insurance lead generation and matching service. We:

• Collect consumer insurance quote requests via our online form
• Match consumers with a single, vetted, licensed insurance agent
• Facilitate the introduction between the consumer and their matched agent

3. Consumer Terms

3.1 Eligibility

You must be at least 18 years of age and a resident of the United States to use our services.

3.2 Accuracy of Information

You agree to provide accurate, current, and complete information when submitting a quote request. Providing false or misleading information may result in an inability to match you with an appropriate agent.

3.3 TCPA Consent

By submitting our quote request form, you provide express written consent under the Telephone Consumer Protection Act (TCPA) to receive one phone call and/or email from a single licensed insurance agent matched by OneCallShield. This consent is not a condition of purchasing any insurance product.

3.4 Free Service

Our service is completely free for consumers. You will never be charged a fee by OneCallShield for submitting a quote request or being matched with an agent.

3.5 No Guarantee of Insurance

While we make every effort to match you with a qualified agent, OneCallShield does not guarantee that you will obtain insurance coverage as a result of using our service. Insurance availability, pricing, and terms are determined solely by the matched insurance agent and applicable insurers.

4. Agent Terms

4.1 Eligibility

To participate as an agent in the OneCallShield network, you must:

• Hold a valid, active insurance license in all states where you operate
• Be in good standing with all applicable state insurance regulatory authorities
• Agree to our Agent Code of Conduct
• Complete our vetting and approval process

4.2 Agent Code of Conduct

All agents in our network agree to:

• Contact matched consumers exactly once via phone unless the consumer requests additional contact
• Never share, sell, or distribute consumer information to any third party
• Contact consumers only at their specified preferred time when possible
• Represent insurance products honestly and accurately
• Comply with all applicable federal and state insurance laws and regulations
• Maintain valid licensing throughout their participation in our network

4.3 Payment Terms

Agents pay for leads either on a per-lead basis or through a monthly subscription as agreed upon during the application process. All payments are non-refundable unless otherwise specified in writing by OneCallShield.

4.4 Termination of Agent Agreement

OneCallShield reserves the right to remove any agent from our network immediately and without notice for violation of our Code of Conduct, loss of licensure, consumer complaints, or any conduct deemed harmful to consumers or our business reputation.

5. Intellectual Property

All content on onecallshield.com including text, graphics, logos, and software is the property of OneCallShield LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Disclaimer of Warranties

OneCallShield provides its services "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that:

• Our service will be uninterrupted or error-free
• Any matched agent will be able to provide the insurance coverage you seek
• Insurance quotes provided by matched agents will meet your expectations

7. Limitation of Liability

To the maximum extent permitted by law, OneCallShield LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to damages related to any insurance products purchased through agents in our network.

OneCallShield's total liability for any claim arising from use of our services shall not exceed $100.

8. Indemnification

You agree to indemnify and hold harmless OneCallShield LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or violation of any third-party rights.

9. Governing Law

These Terms of Service are governed by the laws of the United States and the state in which OneCallShield LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of that jurisdiction.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes by posting the updated terms on this page with a revised date. Your continued use of our services after changes constitutes acceptance of the updated terms.
